The federal suit filed by National Association of the Deaf and Eddie Sierra against the Florida Legislature and Florida State University, as the owner of WFSU, alleges failure to provide closed captioning services on the Florida Channel violating Title II of the American with Disabilities Act and Section 504 of the Rehabilitation Act. The Florida Channel airs live meetings and offers archived meetings of the Florida Legislature both on television and online without captioning. The complaint, filed April 3, 2018, alleges that unless the State is required to eliminate the communication barriers and change their policies to avoid the communication barriers in the future, Plaintiffs will continue to be denied meaningful access to the live and archived recordings of the Florida Legislature. Plaintiff Sierra had filed a complaint with the Federal Communications Commission challenging the lack of closed captioning for live and archived recordings of legislative proceedings, which was dismissed because the legislative proceedings are not shown on television and, as online content only, are exempt from FCC regulations.
